Illegal Acts and Omissions

Illegal Acts and Omissions

If we don't agree with some provision of the law, do we get the luxury of ignoring it?  And if we are caught in the act, will the court throw our case out the window when we explain our opposition to that law?

According to my law book:  Accessory after the fact - "One, who, knowing a felony to have been committed by another, aids the felon to avoid punishment."

Of course, crossing our border without permission is (apparently) not considered a felony.  Because many sanctuary cities have extended their protection to include persons who have been arrested for criminal acts, a question arises:  "Does this protection qualify them as an Accessory After The Fact?"

As far as marijuana is concerned - it is against Federal Law to possess and/or offer marijuana for sale to others - and, depending upon the amount held or offered for sale, it is a felony.

Does the act of passing a State Law or local ordinance in favor of allowing the production and sale of an illegal drug render those elected officials, who voted for this act of defiance, as "Accessories" to a criminal activity?

Since the State, City or County involved acquires income from this illicit activity, could they be charged under provision of the Federal Racketeering (RICO) act for conducting an illegal enterprise?

Currently many of our Legislators representing us in Sacramento are proposing the State of California ought to secede from the Union because the current Federal Administration is threatening to withhold funding to so-called Sanctuary Cities.

One wonders how it came to pass that those we elect seem to be malcontents in pursuit of acts designed to polarize the community against established law.
